The American dream has long been touted to many across the world as the goal of all employees. Unfortunately, not everyone has the skill, education, work experience and circumstances that can get them to America to pursue that dream. Those who do may not be aware that they can be eligible for employment here, but with 140,000 visas available, people need to make sure that they fit into the categories and their paperwork is complete.

First preference

EB-1 visas are available to people who demonstrate extraordinary ability in arts, education, sciences or athletics. They can also be multinational executives and managers or extraordinary researchers or professors.

Second preference

EB-2 visas are for people who are holding advanced degrees in their profession or for individuals with exceptional ability in the sciences, arts or business.

Third preference

EB-3 visas are for other workers, including professionals and skilled workers.

Fourth preference

EB-4 visas are reserved for special immigrants. This can be for certain religious workers, retired employees of international organizations, and US foreign service employees among other workers.

Fifth preference

EB-5 is considered an investor visa, reserved for individuals who invest a certain amount of money into the country.

Some employment visa categories require individuals to have a job offer from the employer already while others require a labor certification from the United States Citizenship and Immigration Services. Employment immigration can be complicated, especially when so much is at stake. An experienced attorney can help interested individuals untangle the complexities involved.
